Puppy Contract/Health Guarantee

All pups are sold with limited registrations/non breeding rights, spay/neuter contract and to pet homes only. We do on occasion release breeding rights. There is an application process. If approved, there’s a fee to release full rights on your contract.



It is HEARBY AGREED BY BOTH PARTIES THAT THE FOLLOWING TERMS AND CONDITIONS WILL BE MET AND
THAT NO OTHER WARRANTIES OR CONDITIONS ARE OTHERWISE IMPLIED
SELLER REPRESENTATIONS

As of the date of this agreement, the puppy is in good health and is free of communicable diseases. Although every precaution has been taken to transfer a healthy puppy, the seller is not responsible for any illnesses that are diagnosed after the buyers initial veterinary health examination, which MUST occur within 72 hours of the date of sale and include a fecal examination. Should the puppy be found in ill health, the puppy may, upon presentation of a written diagnosis from a said veterinarian and a veterinarian of the sellers choice, be returned for a replacement puppy or if there is no pup available at that time, the purchase price of pup be transferred to a future litter. If the condition can be treated, it is NOT considered life threatening. In addition, your puppy comes with a 24 month health guarantee, where the seller warranties the puppy of any congenital defects which will result or may result in a death of the puppy. If the puppy should die from a suspected congenital/genetic defect within 24 months of it’s birthdate, an autopsy must be performed. Seller must be provided a written report of the dogs health problem from the buyers veterinarian. The seller reserves the right to a second veterinarian opinion. The buyer assumes full responsibility for all costs and care during this time. If these conditions are not met, this guarantee is VOID.

The seller will not be responsible for problems resulting from the following: obesity, second hand smoke, malnutrition, dehydration, starvation or lack of proper vet care including regular vaccinations.
Failure to follow medical advise and/or treatment instructions of a veterinarian or seller, will void this guarantee.
Seller is not responsible for any veterinarian bills.
This health guarantee is good for 24 months from the dogs date of birth.

NOT COVERED
Internal or external parasites, hernias, undescended testicles, hooded or recessed vulva, under or overbite, Entropion or Ectropion, injuries, allergies, heat exhaustion, hypoglycemia, and luxating patella. Hypoglycemia can be prevented with good care and feeding. Since a luxating patella or collapsed trachea can be caused by injury, they are not covered if they are not discovered during your veterinarians initial examination. Kennel cough and other communicable diseases are not covered after your veterinarians initial examination.

HEALTH
Seller guarantees that the puppy has received appropriate medical inoculations and care including parvo inoculations and de wormings. Seller will provide the buyer with a medical chart detailing treatment the puppy had received under the sellers care.

MAINTENANCE
Buyer agrees to maintain the puppy in good health, provide routine preventative health care including, but not limited to the following:
*Annual physical examinations by a licensed veterinarian *Rabies vaccinations as mandated by state law *Monthly heartworm preventative
*Proper control of fleas and ticks
*Annual DHLP-Parvo and other routine vaccinations
*Puppy will be licensed as required by your local state law *Puppy will be kept clean physically and in a clean environment KEEP RECORDS!

SPAY/NEUTER
In the past decade, studies have indicated that neutering/spaying too soon or too late can have several adverse health effects on dogs. Some include variations of cancers, behavior issues and joint disorders. It is very important for a puppy to continue to produce essential hormones needed for the proper closure of bone growth plates. Therefore,we require him/her to NOT be spayed/neutered until AFTER his/her first birthday but BEFORE he/she turns 18 months of age. Proof of Spay/Neuter is required. An Ovary Sparing or Vasectomy procedure can be considered at a younger age.


RIGHT OF FIRST REFUSAL
If at any time circumstances are such that the buyer cannot keep the puppy, the seller maintains "right of first refusal" to take possession of the puppy and it's properly signed registration papers, with no monies refunded. The term "Right of First Refusal" means: if the buyer chooses to relinquish ownership of the puppy, the puppy shall automatically be returned to the seller. Under NO circumstances shall the puppy be taken to an animal shelter, humane society, animal broker, pet store, etc. We will NOT refund, in part or in whole, any monies or exchange puppy because of you having changed your mind for any reason whatsoever. Any transportation expense is the buyers responsibility.

Your pup is sold as a pet ONLY with NO breeding rights.

Any guarantee from the breeder is null and void if any terms or conditions herein are not met by the purchaser.
Buyers signature below certifies he/she understands and accepts the terms of this contract fully and that is a legally binding contract.
